Terms and Conditions

1. Your Holiday Contract with Macedonia Travel
< Your contract with Macedonia Travel is subject to the following terms and conditions. Please read them carefully. When you complete our booking form, you and any other person on whose behalf you book, confirm that you have read and understood the terms and conditions of this contract and that you agree to accept them. You also agree that all information given by you is complete and true.
The contract is between Macedonia Travel and the client, being all persons named on the booking as travelling or intending to travel with Macedonia Travel. The person making the booking (which is subject to these terms) warrants that he/she has full authority to do so on behalf of all persons named, and confirms that all such persons are fully aware of and accept these conditions.

2. Bookings & Payments
Your booking will be considered valid only if confirmation is followed immediately by an advance payment of €150,- per person, per trip.
Full payment is required 42 days before travel is due to commence (or at an earlier stage for some components). This payment is deemed to be confirmation that the client has read and accepts the Macedonia Travel booking conditions and the risks involved in the travel.
You can pay to Macedonia Travel by bank transfer or credit card (Visa and Master card). However, a 2% fee is payable if payment to Macedonia Travel is made online by credit card. In the case of non-payment of the balance by the due date Macedonia Travel will treat the booking as cancelled by the client and apply the appropriate cancellation charges.

3. Changes by You
A change of departure date and/or services must be requested in writing by the person who made the original booking. You can change your travel plans up to 30 days before departure free of charge. Less than 30 days before departure we will charge a change fee of €30 per booking. Please note that cancellation costs may arise for the parts that you change. Whilst every reasonable effort will be made to accommodate changes and additional requests their availability cannot be guaranteed.

Group travel: changes of travel plans can be made free of charge up to 60 days before departure.
Changes to flights already purchased: All changes made to the itinerary are restricted as well as subject to airline fare rules, whichever is more restrictive; all our tickets do not allow any date or name changes after the ticket is issued. For any itinerary where changes may be permitted, change fee is charged by Macedonia Travel plus Airline penalties and any fare difference.

4. Changes by Us
While Macedonia Travel will do its best to operate all components as advertised, by accepting this contract the client accepts that it may prove necessary or advisable to vary or modify a component itinerary or its contents due to prevailing local conditions. Macedonia Travel reserves the right at any time either before or during a component to cancel or change any of the facilities, services or prices described (including flights, transport, accommodation or other arrangements) and to substitute alternative arrangements of comparable value without compensation and accepts no liability for loss of enjoyment as a result of these changes.
If a major change becomes necessary Macedonia Travel will inform the client as soon as reasonably possible if there is time before departure. The definition of a major change will depend on the individual component and circumstances and is at the sole discretion of Macedonia Travel. When a major change is made the client will have the choice of accepting the change of arrangements, or within 7 days notification of the change, purchasing another available component or cancelling the component and obtaining a full refund, provided that the major change is not because of force majeure.
Force majeure is war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, disease, fire or adverse weather conditions, technical or maintenance problems with local transport or Macedonia Travel vehicles, changes imposed by cancellation or rescheduling of flights by an airline or main charterer, the alteration of airline or aircraft type, or other similar events beyond the control of Macedonia Travel. Macedonia Travel is not liable for any penalty charges associated with non-refundable airfares, in the event of a change to a component departure time, date or airport. All costs incurred due to force majeure such as transportation, communication, accommodation, food or other similar items will be passed to the client by way of local surcharges. See clause 6.

5. Cancellation by You
The client may cancel the booking at any time provided that the cancellation is made to Macedonia Travel in writing. Written notification is essential even if verbal notification of an intention to cancel has been given. Cancellation charges will be applied as shown below calculated from the day written notification is received by Macedonia Travel. In addition to the charges shown below airlines may impose 100% cancellation charges and the cost of a new ticket. The date used for calculating cancellation charges will be as follows:

Group tours:
– Less than 50 days and more than 30 days prior to departure: refund of 50% of the payment made.
– Less than 30 days and more than 15 days prior to departure: refund of 20% of the payment made.
– 15 days or less: No refund.
Independent travel:
– Less than 30 days and more than 20 days prior to departure: refund of 50% of the payment made.
– Less than 20 days and more than 10 days prior to departure: refund of 30% of the payment made.
– 10 days or less: No refund.

Most airline tickets are fully non-refundable. In certain cases where the Airline may allow cancellations, a credit may be available for future ticket purchase with applicable penalty and a fare difference if any, with travel valid on the same airline. Usually the credit is valid with time constraints and a specific expiration date and should be discussed with the air travel agent. All such bookings where the cancellation may be permitted must be cancelled prior to the scheduled departure time of the first flight segment by calling our air travel agent. We do not guarantee any cancellation or refund. The credit will be held for a limited time period, please ask the air travel agent for the specific date by when you must use this credit or you will lose the credit amount. When you are ready to make the new booking, you will have to pay fare difference (if any), applicable airline penalties for that fare and Macedonia Travel exchange fees. All such changes are governed by the airlines' rules and regulations, Macedonia Travel does not provide any representations or guarantees on changes or fees. Our agent will assist you in locating your desired new flights and attempt to re-book the new flights based on availability and other factors.

6. Cancellation by Us
Macedonia Travel reserves the right to cancel a component in any circumstances but will not cancel a component less than 4 weeks before the component starts, except for force majeure, or the client’s failure to make all payments. Unless the client fails to pay the final balance Macedonia Travel will, upon cancellation, return all monies paid excluding payment for travel insurance and administration charges or offer an alternative component of comparable standard.

Cancellations due to Force Majeure
In addition to the cancellation rights set out above, we may be required to cancel your trip, due to a Force Majeure Event occurring at your holiday destination or its immediate vicinity and significantly affecting the performance of the holiday.

In these circumstances, we can offer you a choice of:
- a 100% credit of monies paid for your trip; or
- a refund minus unrecoverable costs.

A “Force Majeure Event” includes but is not limited to: acts of God; war; civil commotion; riot; blockade or embargo; fire; explosion; breakdown; union dispute; earthquake; epidemic, pandemic or other health emergency; flood; windstorm or other extreme weather event; lack or failure of courses of supply; passage of any law, order, proclamation, regulation, ordinance, demand, requisition or requirement or any other act of any government authority, beyond the reasonable control of the parties, whether or not foreseeable, which would make it dangerous or not viable for a trip to commence or continue.
In the event of any cancellation, there will be no claim for damages by either party against the other and we are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

7. Prices & Surcharges
Macedonia Travel reserves the right to increase the component price and / or local fund to take account of the following items: entrance charges, government action, currency, operations costs, transportation costs, including the cost of fuel, over flying charges, airport charges and increases in scheduled airfares. Macedonia Travel will not surcharge if the increase is less than 2% of the component price (excluding local funds). Macedonia Travel may apply the full costs of a surcharge if the increase is 2% or more of the component price (excluding local funds). If the surcharge results in an increase of more than 10% of the component price the client may cancel the booking within 7 days notification of the surcharge and obtain a full refund.
The above conditions do not apply to the following circumstances:
a) In the event of local flight cancellations, overbooking or rescheduling of departure days and times, Macedonia Travel reserves the right to charge the extra costs from the client. In such cases, the client will have the choice to wait for the next available scheduled flight and miss some tour services included or pay any additional costs associated with upgrades or chartering aircraft as a substitute by way of local surcharges.
b) Fuel surcharges due to increases in fuel costs for local transport or Macedonia Travel vehicles may be applied and invoiced before your departure if there is adequate time to do so. Any fuel surcharge applied must be paid in full either in advance or by way of local surcharges as advised, failure to pay will result in the client being prevented from joining the component without refund.

8. Travel Insurance
Travel insurance is mandatory for all clients of Macedonia Travel. Clients together with their personal property including baggage are at all times solely at their own risk. Clients are wholly responsible for arranging their own insurance. A suitable insurance policy should provide adequate cover for medical expenses arising through illness or accident prior to or during the component and loss of component monies through cancellation or curtailment of the component for insurable reasons. Macedonia Travel is able to assist clients in obtaining a suitable insurance policy. Clients making their own arrangements should ensure that there are no exclusion clauses limiting protection for the type of activities in their component. Clients should satisfy themselves that any travel insurance arranged through Macedonia Travel is what they require and should arrange supplementary insurance if need be. Proof of adequate insurance will be requested at the start of your component. Failure to provide this will result in the client being prevented from joining the component without refund.

9. Passports, Visas and Vaccinations
It is the responsibility of the client to be in possession of a valid passport, visa permits, vaccinations and preventative medicines as may be required for the duration of the component.

10. Participation and client responsibility
All clients are expected to satisfy themselves prior to booking that they are fit and able to complete the itinerary of their chosen component as described by Macedonia Travel. Clients are also expected to accept that the components described constitute “Adventure Travel” and that travel to and facilities in developing countries will not be to similar standards which they may be accustomed to at home.
Clients agree to accept the authority and decisions of Macedonia Travel’s employees, tour leaders, and agents whilst on components with Macedonia Travel. If in the opinion of such person the health or conduct of a client before or after departure appears likely to endanger the safe, comfortable or happy progress of a component the client may be excluded from all or part of the component, at his or her own expense, and without any refund. In the case of ill health Macedonia Travel may make such arrangements as it sees fit and the associated total costs of these arrangements including expenses of Macedonia Travel must be paid for by the client. If a client is excluded as above or chooses to leave of their own free will or leaves due to ill health or any other reason there will be no refund of the component price, extra services surcharges, local fund or any local surcharges. All services forming part of the whole package booked will be forfeit though may be recoverable through your travel insurance in some circumstances.

11. Local Laws
All participants in components operated by Macedonia Travel are expected to obey the laws and regulations of the countries visited and any failure to do so will relieve Macedonian Travel of all obligations that they may otherwise have under these booking conditions.

12. Illness or Disability
Anyone suffering from illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment which may be required during the component. Failure to make such disclosure will constitute a breach of these booking conditions and result in such persons being excluded from the component in which case all monies paid will be forfeit.

13. If you have a Complaint
If the client has a complaint about any of the component arrangements the client must bring it to the attention of the tour leader or other representative of Macedonia Travel at the time so that they may use their best endeavors to rectify the situation. It is only if Macedonia Travel is made aware of any problems that there will be the opportunity to give solutions. Failure to complain on the spot will result in the client’s ability to claim compensation from Macedonia Travel being extinguished or at least reduced. Should the problem remain unsolved a complaint must be made in writing to Macedonia Travel within 7 days of the completion of the component or all claims for compensation will be forfeited.

14. Our Responsibilities
The components operated or supplied by Macedonia Travel have been designed to provide participants with an exposure to the true nature of the environment visited and therefore involve an element of personal risk and exposure to potential hazards over those associated with normal “package travel”. All bookings are accepted on the understanding that such risks and hazards are accepted by the client and that they undertake all activities at their own will and at their own risk.
a) Where the client does not suffer personal injury, Macedonian Travel accepts liability should any part of the component arrangements booked with Macedonia Travel not be supplied as described and not be of a reasonable standard. In such a case, Macedonia Travel will pay reasonable compensation if the component arrangements had been adversely affected but will pay no compensation if there has been no fault on the part of Macedonia Travel and the reason for the failure in the component arrangements was due to force majeure, the client’s fault, the actions of someone not employed in Macedonia Travel or could not have been foreseen or avoided by Macedonia Travel even if all due care had been exercised.
b) Where the client suffers death or personal injury as a result of an activity forming part of the component arrangements booked with Macedonia Travel, Macedonia Travel accepts responsibility unless there has been no fault on Macedonia Travel’s part and the cause was due to force majeure, the client’s fault, the actions of someone not employed in Macedonia Travel, or factors which Macedonia Travel could not have anticipated or avoided even if all due care had been exercised.

15. Flight Bookings
Macedonia Travel will use its best endeavors to ensure that all flight prices and pre-paid taxes are correct at the time that they are quoted. Airlines reserve the right to amend or withdraw fares without prior notice. The fare can only be guaranteed when the flight booking has been paid for in full to Macedonia Travel and a ticket has been issued. Flight bookings cannot be transferred.

16. Photographic Release
Macedonia Travel reserves the right to take photographic or film records from any of its trips. Clients travelling through Macedonia Travel should be aware that Macedonia Travel may use any such photographic or film records for promotional and/or commercial purposes, or joint marketing projects with third parties, without remuneration to the clients.

17. Brochure / Website / Advertising Material Accuracy
The information contained in our brochure, on our website and in other advertising material is believed correct to the best of our knowledge at the time of publication. Errors may occasionally occur, and information may subsequently change therefore please ensure you check all details of your chosen component (including the price) with us or your travel agent at the time of booking. Macedonia Travel cannot be held responsible for any error, omission or unintentional misrepresentation that may appear in this brochure, on our website or in other advertising material.

18. General
This Website is operated by a Macedonian entity and this Agreement is governed by the laws of the Republic of Macedonia. You hereby consent to the exclusive jurisdiction and venue of courts in Skopje, Republic of Macedonia, in all disputes arising out of or relating to the use of this Website. Use of this Website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph. You agree that no joint venture, partnership, or employment relationship exists between you and the macedoniatravel.com Companies as a result of this Agreement or use of this website.
